Synopsis

No one plans on being injured in an accident, a victim of medical malpractice, sexually or brutally assaulted, abused in other ways, molested as a child or injured in some way by a product they used, but when it happens they often find themselves at a loss as to how to receive fair compensation for their injuries and the treatment they deserve. The lawyers at Q Auto & Injury Attorneys, McCue, Reams & Associates tell stories, share experiences and offer advice to victims who are simply overwhelmed by how the system works and what their rights are under the law when they are injured. Sometimes proper compensation can come quickly through negotiations and other times what ís right must come through the courts. Attorneys, with years of experience in personal injury, accident and malpractice cases, explain the ins and outs of how to go about getting a fair settlement. These video and audio podcasts are offered twice monthly and, on occasion, with extra Episodes when news stories or changes in the law dictate.

When you get to that question you want to be able to truthfully say, "There was nothing I could do". There are many laws to follow when you're driving. • Episode 51 ER Nightmare

    29/09/2015 Duration: 02min

Without a doubt some of the most difficult cases we handle are those involving children. A heart transplant at the age of thirteen is scary, but it went well. Just a short while ago she turned fifteen. She told her mother that she wasn't feeling well. Her mother took her to the emergency room of a local facility. The teenager told the nurses there, "I am not right. I need to see someone immediately. I feel as though I am dying." It wasn't until 4 hours later that the cardiologist finally arrived in the emergency room. Check out the rest of the story in our podcast as told by Medical Malpractice Attorney Sandra Bucha. Then, if this case sounds similar to a situation you’ve encountered give us a call. We can help. Our toll free number is 800-332-1992 or email us at info@qlaw.com.

  • Episode 50 Why Take Your Case To Trial?

    15/09/2015 Duration: 01min

Board Certified Trial Attorney Derek Reams talks about why it is important to find a lawyer with a reputation for taking cases to trial. With the internet, Google, Yahoo and all of the social media outlets that we have at our disposal, how do you pick an attorney that's going to best represent you and handle your case? My suggestion would be to call that attorney directly. Ask them a variety of questions. Ask how many times has that law firm handled your type of case? Ask if that law firm in fact takes their cases all the way to trial? Find out why those questions are critical in this podcast and if you have questions give us a call. We can help. Our toll free number is 800-332-1992 or email us at info@qlaw.com.

  • Episode 49 Examination Under Oath

    01/09/2015 Duration: 01min

An “Examination Under Oath” is the first time the insurance company gets to talk to you “on the record” regarding your accident and the medical treatment you’ve received surrounding that accident. Often, these examinations are to help the insurance company figure out if they're going to pay the full personal injury protection benefits or to value any future settlements you may be entitled to should you carry under insured motorist coverage on your own policy. These examinations are nothing to be worried about. It's simply a time for them to gather facts and for you to tell your side of the story. Still it’s important to have an attorney there with you throughout the entire process to protect your rights. Find out why in this podcast and if you have questions give us a call, we can help. Our toll free number is 800-332-1992 or email us at info@qlaw.com.

  • Episode 48 PIP Update!

    18/08/2015 Duration: 02min

Florida's PIP, (P – I – P) personal injury protection. It’s a mandatory part of your auto policy in the state of Florida. At one point it meant, if you were injured in an auto accident you could count on $10,000 worth of coverage for your medical bills and or your lost wages. It isn't any longer. Now in order for your PIP to be used to pay your medical bills, your injuries have to be declared as an emergency. You have to have sought emergency treatment at the outset of injuries. If you go to the emergency room it's pretty hard for an insurance company to argue that you didn't have an emergency medical condition. There’s more, watch the podcast to learn more about the changes to PIP. If you have any questions after watching our podcast call us. We're Q Auto and Injury Attorneys. Our toll free number is 800-332-1992 or email us at info@qlaw.com.

  • Episode 47 FDA Approved: Doesn’t Always Mean Its Safe For You

    04/08/2015 Duration: 01min

Just because the FDA has approved a particular drug does not mean that in your particular situation it is the proper drug for you. You can’t wait to hear about these drugs on TV. By then it’s too late. You need to ask your doctors, healthcare providers and pharmacists about all of the risks and complications that might occur from your taking any one particular drug. When you pick up your prescriptions from the pharmacy, be sure to read not only the label instructions and precautions but read the package inserts as well. You need to be fully aware of the possible consequences of taking any particular drug. In the long run it is your responsibility to be informed and really in your best interests. If you or a loved one has been injured by a medication or malpractice give us a call. We can help. Our toll free number is 800-332-1992 or email us at info@qlaw.com.

  • Episode 46 Compulsory Examination

    21/07/2015 Duration: 02min

As your case proceeds through the litigation process the Florida Rules of Civil Procedure allow for your insurance company to send you to a doctor of their choosing for examination. Often our clients will question why the insurance company sends them to doctor when they can get all the information they need from the doctors who have been treating them for their injuries since the accident. Basically it gives your insurance company the opportunity for a full evaluation of your case and the opportunity to try to refute all or portions of your claim as they prepared for trial. If this sounds familiar or you think you have a personal injury/malpractice case that we can help you with give us a call. Let’s talk. Our toll free number is 800-332-1992 or email us at info@qlaw.com

  • Episode 41 The Black Box

    11/05/2015 Duration: 02min

Eyewitness testimony has always been vital to determining how an accident occurred. More often than not though, eyewitnesses can see things in differing ways. One driver says, "I was going thirty five miles an hour". The other driver says, "No that's not true you are going at least fifty five miles an hour". The jury is then asked to believe which driver is the most credible in determining who was at fault. Technology is changing that now. Many newer motor vehicles have black boxes similar to those in airplanes. With these black boxes information such as speed, the direction of the steering wheel, how much the brake pedal was depressed, how much the accelerator was depressed and similar information can be downloaded from the car itself and becomes extremely important to figuring out who was in fact at fault for the crash. Contacting a law firm that’s familiar with the technology in today's cars is imperative for you and preserving all evidence and information is important for your case. Most importantly it ca

  • Episode 35 Reasonable Compensation

    17/02/2015 Duration: 03min

Just because a lawyer gets a large settlement for you doesn't mean that he will put a lot of that settlement in your pocket. It doesn't end there. In order to get a substantial settlement in a case it is more likely than not you've endured a great deal of pain and suffering because of the physical problems the accident or the malpractice caused you. That means very often that the amount of money that we get for you may not cover all of your medical bills and still put a sizable portion in your pocket. The lawyer you hire should feel obligated and in fact be obligated to do everything in his or her power to reduce those medical bills. Believe it or not those bills can be negotiated not unlike you're negotiating to purchase a used car. There is a certain amount of money that the doctor or the medical provider has already determined is necessary to cover their expenses in your treatment. It's the responsibility of your lawyer to determine the minimal amount of money necessary to have covered those expenses and b

  • Episode 34 Mediation - A Florida Requirement

    03/02/2015 Duration: 02min

Here in Florida, our courts require personal injury cases to go to mediation prior to trial. The mediation process is simply where we sit down with the attorney for the insurance company, a representative with the insurance company itself and a mediator. Both sides give a factual overview of their version of the case and then we actually begin discussing settlement of your case. Your case has been worked up to the point where you've received your medical care. Your deposition has been taken by the insurance company's attorney and now they know a lot of the information they need to properly evaluate your case. Obviously our goal of mediation is to get the best settlement we can for you. Any information that you can provide to document and demonstrate how your life has changed by your injuries is extremely helpful. Pictures or video are important. Logs and journals that you keep on a regular basis that not only include your medications and doctors visits but simple notes on how you were feeling or what activity
